JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 27-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Surajgarha P.S. Case No. 56 of 2015 registered under Sections 302 read with 34 of the Indian Penal Code. Regard being had to the fact that the petitioners were though named in the FIR, on completion of investigation, the police submitted final report showing them innocent and the coaccused Nawal Kishore @ Nawal Kishore Prasad @ Damodar Prasad Gupta and Anamika Devi @ Anamika Sugandha having

Patna High Court Cr.Misc. No.57285 of 2015 (2) dt.27-01-2016 2 / 2 identical allegations have been granted privilege of pre-arrest bail by co-ordinate Benches of this Court vide order dated 04.01.2016 passed in Cr. Misc. No. 58043 of 2015 and the order dated 07.01.2016 passed in Cr. Misc. No. 27943 of 2015 respectively, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S. Case No. 56 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
