Mr. Siddhartha Prasad, learned counsel appearing on behalf of the petitioner, submits that the relief sought by the petitioner is two fold, the first relief is with regard to grant of promotion from the post of Associate Professor to the post of University Professor, in the Department of Geography, with effect from 01.04.2007 and the another relief is with regard to release and payment of all retiral dues to the petitioner, including gratuity, earned leave encashment, provident fund, group insurance and any other admissible benefits along with statutory interest for the delay within the time stipulated.

Counsel for the petitioner next submits that with regard to grant of promotion, the respondent Patliputra University may be directed to constitute a Selection Committee to consider the promotion of the petitioner on the post from its due date and, in respect of payment of retiral dues, the authorities of the University may be directed to adjudicate the claim of the petitioner in reference to the documents appended with the writ application and, as also, the same having been filled through representation date 09.03.2026, which is appended with the writ petition as Annexure-P/14, at page 82.

On the other hand, counsel for the Patliputra University submits that the petitioner may be directed to cooperate with the authorities of the university with all such documents, if so directed and necessary decision shall be taken in respect of the retiral dues, once such requirements are fulfilled.

With regard to the promotional issues, the counsel submits that necessary steps would be taken for constitution of the Selection Committee and, once such Committee is constituted, the petitioner's case for grant of promotion to the post of University professor in the concerned department with effect from due date shall be considered and necessary decisions

3/4 so taken shall be notified and same shall be communicated.

6. At this stage, counsel for the Patliputra University submits that the authorities of the Magadh University may also be directed to provide necessary documents in adjudicating the claim of the petitioner as and when required by the authority of the Patliputra University.

Considering, the submissions of the parties, this Court finds it appropriate to direct the Vice Chancellor of Patliputra University to consider the claim of the petitioner with regard to promotion by constituting a Selection Committee in this regard and, as also, by adjudicating the claim of the petitioner with regard to retiral dues with statutory interest, if applicable, which is still pending adjudication at the level of Patliputra University within a period of eight weeks from the date of representation filled by the petitioner along with a copy of this order.

Needless to say that the petitioner would corporate with the authorities in getting the claim adjudicated and, if need be, the authorities of the Patliputra University is always at liberty to seek such documents as is required for adjudication of the claim of the petitioner by writing to the Registrar of the Magadh University, who shall corporate with them on such

4/4 requirement being placed on record by the authority of the Patliputra University.

9. With the aforementioned observation and direction, the writ petition stands disposed of.
