JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-10-2016 Learned Senior Counsel appearing on behalf of the petitioners has submitted that in extraordinary circumstance beyond the control of the petitioners, they could not appear before the Court below within four weeks from 28.04. 2014, in the light of order passed in Cr. Misc. No. 8948 of 2014. He submits that the petitioner No.1 is suffering from serious ailment. It appears from the order, dated 28.04.2014, modification of which is being sought by extending the time for the petitioners to surrender before the Court below that the disputed amount had been deposited by the petitioners.
Considering it to be an exceptional circumstance, this application is allowed and the time for the petitioners to surrender
before the Court below as indicated in the order, dated 28.04.2014 passed by this Court in Cr. Misc. No. 8948 of 2014 in connection with Haspura P.S. Case No. 74 of 2011 is extended by three weeks from today.
