1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 126(2), 115(2), 109(1), 351(3) of the B.N.S.

The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case, but then, inadvertently at Para-3, it has been pleaded that petitioner no.1 is a person with clean antecedent. It is next submitted that the informant alleges that on 01.01.2025 at about 4.00 P.M. while he was returning to his house, when he was intercepted by the
Patna High Court CR. MISC. No.28209 of 2025(4) dt.13-08-2025 2/3 accused persons including the petitioners, who were variously armed and Chitranjan, Shivam, Vivek and Ranjan assaulted the informant on his head causing injury while other accused assaulted with lathi and danda.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that four accused assaulted the informant, but then, the informant has received only two injuries and there is no specific allegation of assault against the petitioner no.2.

Learned A.P.P. opposes the anticipatory bail application and submits that from perusal of Annexure-2, it would manifest that injury suffered by the informant is opined to be grievous and petitioner no.1 is alleged to have assaulted along with Shivam, Vivek and Ranjan, but then, fairly submits that no specific allegation of assault is alleged against the petitioner no.2.
6. Considering the submissions made by the learned A.P.P., the petitioner no.2, Aditya Kumar @ Aditya Singh @ Aditya Kumar Singh, above-named, in the event of his arrest or surrender before the learned Court below within a period of six
Patna High Court CR. MISC. No.28209 of 2025(4) dt.13-08-2025 3/3 weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Risiap P. S. Case No.03 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. So far as the petitioner no.1, Chitranjan Kumar @ Kunjan Kumar Singh @ Chiranj Kumar @ Chitranjan Kumar Singh is concerned, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner no.1.
8. The prayer of the petitioner no.1 for anticipatory bail stands rejected.
