This application for anticipatory bail arises out of Kawakole P.S. Case No. 42 of 2017, disclosing offences under Sections 147,149,341,323,324,325,307,379,504 and 506 of the Indian Penal Code.

There is allegation against the petitioner of making assault with Garasa on informant's son causing head injury. This part of the prosecution version is supported from the injury report, which is available with the case diary inasmuch as the injury has been found on the head of the informant's son caused by sharp cutting weapon. A case of commission of offence under Section 307 of the Indian Penal Code is made out. This is not a case for grant of anticipatory bail.

The petitioner is directed to surrender before the Court below within four weeks from today, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for anticipatory bail by this Court.
