The petitioner seeks bail in a case registered under Sections 401, 411, 413, 414, 379, 120(b) of the Indian Penal Code.

Allegation against the accused persons is of committing theft of motorcycles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional statement of co-accused. No incriminating article has been recovered from the conscious

Patna High Court CR. MISC. No.26272 of 2019(2) dt.23-04-2019 2/2 possession of the petitioner. No T.I.P. has been conducted. Other co-accused has been granted bail vide Cr.Misc.No.24074 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Kotwali P.S. case No.896 of 2018.
