The petitioner is apprehending his arrest in connection with Pakaridayal P.S.case No.113 of 2017 , registered for offences punishable under Sections 365, 366(A), 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that she is mother of Mukesh Sahni with whom the daughter of the informant eloped and she had married with him, which will appear from the statement recorded under Section 164 Cr.P.C., which is Annexure 2 to this petition and she has also disclosed her age as 23 years.

Heard learned A.P.P. also.

No.26478 of 2019(2) dt.23-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Pakaridayal P.S.Case No.113 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
