2. The present writ petition has been filed for a direction to the respondent to include the name of the petitioner in provisional merit list of General Category for appointment on contract basis on the vacant post of IT Manager.

3. Pursuant to the advertisement issued by the Bihar Administrative Reforms Mission Society, the petitioner had applied for the post of IT Manager on contract basis in the year 2011 and thereafter the Society has issued a provisional merit list (Annexure-

4) in which the petitioner's name is not included in the merit list. Aggrieved by the action of the respondent, the petitioner has filed the present writ application to include the name of the petitioner in the panel list.

Learned counsel for the State has filed a counter affidavit stating therein that the provisional merit list was prepared (Annexure-4) on the basis of information received through online application subject to verification of the original documents. Although the petitioner has got M. Tech degree but he does not have the basic qualification required for appointment decided for the said post i.e. Engineering Graduate in I.T./Computer Science/Computer Engineering. Since the petitioner does not have the basis qualification required for appointment to the said post so, the instant Committee did not recommend the name of the petitioner for provisional merit list.

5. Considering the stand of the State Government, there is no merit in the writ petition and hence the writ petition stands dismissed.
