2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363, 366 (A), 34 of the I.P.C. and 8, 12 of POCSO Act. of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with other co-accused persons kidnapped the minor victim girl for the purpose of marriage.
4. It is submitted that victim in her statement under 164 Cr.P.C has stated that she was in love with this petitioner and they went to Nepal and solemnized marriage and lived there for one month.
5. Considering the 164 Cr.P.C statement of the victim
Patna High Court CR. MISC. No.29120 of 2023(2) dt.17-07-2023 2/2 and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge cum special Judge, POCSO Act, East Champaran at Motihari, B Bihar in connection with Turkauliya (Raghunathpur O.P.)
