2. In view of statement made in paragraph-13 of the counter affidavit that preparation of panel for appointment on Group D post is under process at the District Level, learned counsel for the petitioners submits that the petitioners' clam is under consideration.

3. Learned counsel for the State submits that the petitioners who were Seasonal D.D.T. Sprayers are being considered along with others, as per requirements in terms of the Bihar Group-D Recruitment and Service Condition Rule, 2010, and the seniority list prepared in this regard by the Office of the Civil Surgeon, Madhubani.

4. Since it is not in dispute that process is ongoing, pendency of the instant writ application would serve no purpose. The petitioners' claim would be considered according to the requisite qualifications, including seniority list etc., in

Patna High Court CWJC No.22489 of 2011(3) dt.23-02-2023 3/3 accordance with law.
