====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 09-09-2025 The petitioner has filed the instant application for the following reliefs:

"1. That this is an application for issuance of appropriate writ/writs, order/orders direction/ directions commanding the respondent authorities to keep in abeyance the Departmental proceeding initiated vide memo no. 4423 dated 02.07.2020 issued under the signature of Deputy Secretary cum Deputy Director (Prison), Bihar Patna whereby and whereunder decision has been taken for initiation of a departmental proceeding under Rule 17 of Bihar Government Servant

Patna High Court CWJC No.7574 of 2022(3) dt.09-09-2025 2/2 (Classification Control and Appeal Rule 2005) and petitioner is directed to shown his cause within 15 days pursuant to charges contained in letter no. 1035 dated 10.05.2020 and said charge is based on a criminal case being Hajipur Sadar P.S. case no. 04/2020 u/s 302, 120(B) of the IPC and section 27 of Arms Act and section 52 of Prison Act and in such circumstances Departmental proceeding may be stayed till disposal of the Criminal Case.

A Copy of memo No. 4423 dated 02.07.2020 is annexed herewith and marked as Annexure-1 to this petition.

Petitioner further seeks any other relief/reliefs for which he is found entitled in the eye of law and in the facts and circumstances of the present case."

2. It is submitted by learned counsel for the petitioner that the application having become infructuous, he seeks permission to withdraw this application.
