ANJANA MISHRA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being a Pardanashin lady apprehends her arrest in connection with a case registered for the offences punishable under Sections 147, 148, 149, 342, 337, 353, 307, 504 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 of the Bihar Crime Control Act.

Learned counsel for the petitioner submits that the petitioner has been victimized and she lives alone with her three minor children and her husband was outside the country. It is submitted that only because she resisted the Police and was preventing them from entering her premises, the petitioner has been named in connection with the present case and the allegation which has been levelled against her that she was protecting some person who was

Patna High Court Cr.Misc. No.57461 of 2015 (2) dt.04-01-2016 P2/2 running away from Police and was a fugitive from justice is wholly misconceived.

Considering the nature of allegations made against the petitioner that she is a pardanashin lady and that she has no criminal antecedent, let the petitioner, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned SubDivisional Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. Case No. 152 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
