JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Bhagwanpur P.S. Case No. 113 of 2016 for the offences instituted under Sections 409 and 420 of the Indian Penal Code. The allegation against the petitioner is that while working as Panchayat Teacher of Torhi Gram Panchayat in the District of Kaimur, he could not make available to the Vigilance Investigation Bureau, relevant registers ands folders relating to appointments made to the post of Panchayat Teachers in the year 2003 onwards.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been

Patna High Court Cr.Misc. No.42317 of 2016 (7) dt.15-12-2016 2/2 implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a Panchayat Secretary of the concerned panchayat. From perusal of the F.I.R. itself, it is evident that the Predecessor of the petitioner had not submitted the entire documents in respect to the appointments of the Panchayat Teachers. Hence, whatever the document was there with the petitioner, has already been submitted by the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner vide order dated 05.10.2016, is hereby, confirmed.
