JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-12-2022 The present writ petition has been filed seeking the following relief:- "1. That the petitioner prays for issuance of a writ preferably in the nature of mandamus commanding and directing the respondents concerned to count the period from 19.07.1975 to 31.12.1979 for the purpose of pensionary and other monetary benefits to the petitioner in view of Government decision, as the earlier service of an employee shall be counted for pensionary benefit and the claim of the petitioner in this regard has been kept pending by the respondents without any valid reason."

At the outset, the learned counsel for the respondentState has referred to paragraph no. 4 of the counter affidavit,

Patna High Court CWJC No.18162 of 2014(3) dt.05-12-2022 2/2 filed on behalf of the respondents no. 1 to 3 wherein they have stated that the representation of the petitioner has been rejected by the Animal and Fisheries Resources Department vide Letter No. 357 dated 28.01.2015, however it is submitted by the learned counsel for the petitioner that the said letter has not been handed over to the petitioner, hence the respondents be directed to supply a copy of the same to the petitioner. Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Director, Department of Animal Husbandary and Fisheries, Government of Bihar, Patna to handover the aforesaid letter dated 28.01.2015, in case the petitioner approaches the said authority by filing appropriate representation, within a period of four weeks from today.
