Patna High Court CR. MISC. No.31665 of 2024(2) dt.21-05-2024 2/3 ORAL ORDER 21-05-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 341, 323, 307, 354(B), 325 , 379, 452, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of occurrence, all the accused persons, including the petitioner, entered the house of the informant and tried to outrage the modesty of the daughter and daughter-in-law of the informant. Upon protest, all the accused persons assaulted the informant and others, as a result of which they sustained injuries.
4. It is submitted on behalf of the petitioners that both the parties are close door neighbours and due to petty dispute a simple occurrence of maarpeet took place between them. Case and counter case . Allegation of assault is general and omnibus. Injury allegedly caused by these petitioners are simple in nature . Petitioners claim clean antecedent.
5. Learned counsel for the State opposes the bail petition.
6 Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.31665 of 2024(2) dt.21-05-2024 3/3 of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate Vth , Kaimur at Bhabua in connection Bhagwanpur P.S. Case No. 275 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
