NATH ORAL ORDER 28-04-2015 Heard the learned counsel for the petitioners. The learned counsel for the petitioners has submitted that his prayer is confined to a direction to the court below to dispose of the injunction petition filed on 27.08.2013. It has also been submitted that the said petition was heard on several dates but the order sheet does not reflect the said position. The

Patna High Court CWJC No.17877 of 2014 (2) dt.28-04-2015 learned counsel has also drawn the attention of this Court to the order sheet annexed with the writ application to strengthen his stand.

In the aforesaid fact situation, this Court finds substance in the prayer on behalf of the petitioners for a direction to the court below to dispose of the pending injunction application filed in the year 2013. As such, this writ application is disposed of with direction to the learned court below to dispose of the pending injunction application in accordance with law on its own merits expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order. In view of the nature of the direction, which has been passed, this Court has found that the notice to the respondents is not necessary.

The writ application is, accordingly, disposed of with aforesaid direction.
