The petitioner seeks bail in Bihta P.S. Case No. 74/2019, instituted for offence under Section(s) 395 and 412 of the Indian Penal Code.

It is alleged in the written report that the police got information that few persons have looted the container bearing Registration No. NL-02Q-7408. The police reached at the place of occurrence and found the aforesaid container was parked but no any persons were found in the container. In the next morning at about 3 A.M. one Scorpio came in front of the said container and two persons got down from the Scorpio and boarded in the container. Rest persons were seated in the Scorpio. The police seized the Scorpio. In the meantime one person fled away from

Patna High Court CR. MISC. No.29822 of 2019(2) dt.08-05-2019 2/2 the Scorpio. The police arrested two persons from the Scorpio and two persons from the aforesaid container, who disclosed their name as Sonu Kumar, Md. Tinku, Sushil Verma and Aftab Ali.

Learned counsel for the petitioner has submitted that the other co-accused with similar allegation has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 20035/2019 dated 01.05.2019.

Petitioner is in custody since 22.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Danapur, Patna in connection with Bihta P.S. Case No. 74/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
