Permission is accorded.
This application is dismissed as withdrawn against petitioner no. 2.
So far as petitioner no. 1 is concerned, the instant application for anticipatory bail has been filed by petitioner no.
1. apprehending his arrest in connection with Beldaur P.S. Case no. 139 of 2021 instituted for the offence under Sections 341, 323, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Patna High Court CR. MISC. No.27631 of 2022(3) dt.29-11-2022 2/3 As per allegation in the FIR, informant was in love with a minor girl, who is sister-in-law of petitioner no. 1. Petitioner no. 1 has suggested the informant to gift a mobile phone to his sister-in-law. One day prior to lodging this FIR, informant went to her village to provide her a mobile phone, suddenly, four-five accused persons including the petitioner surrounded him and started to assault him. On arrival of police party, informant was saved by them and he was sent to Health Center for treatment.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. From perusal of injury report, it appears that informant has sustained injury caused by hard blunt substance which is simple in nature. General and omnibus allegations have been levelled against the petitioner.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner no. 1 on bail. The petitioner no. 1 is directed to surrender in the Court below within a period of four weeks from today and in the event of his

Case no. 139 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria subject to the conditions as laid down under section 438(2) of the Cr.P.C.
