JUSTICE BIRENDRA KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. For land dispute, the petitioner allegedly committed assault with lathi causing injury at the head of his full-brother who is informant of this case. There is counter case also. Submission of the learned counsel for the petitioner is that the Doctor has found simple injury. There is no allegation of repetition of blow.
Considering the fact that the petitioner had knowledge that his act might cause death, I am not inclined to enlarge him on anticipatory bail in connection with Bariarpur P.S.
Patna High Court Cr.Misc. No.42498 of 2017 (2) dt.21-09-2017 2 /2 Case No. 26 of 2017 pending in the court of learned Chief Judicial Magistrate, Munger.
Hence, prayer for bail is refused.
In the event of surrender of the petitioner within four weeks prayer for regular bail shall be disposed of without being prejudiced by this order.
