JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner seeks anticipatory bail in connection with Kudra P.S. Case No. 226 of 2016 instituted for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
The allegation against the petitioner is that the State Food Corporation provided 4000 quintals of paddy to the petitioner and after milling 2680 quintals rice was to be provided, but only 1617.84 quintals of rice after milling was given to the State Food Corporation and 1062.16 quintals of rice was remained pending with the petitioner, which is of Rs. 23,00,171.21/-.
Patna High Court Cr.Misc. No.45306 of 2016 (2) dt.15-12-2016 2/2 It has been submitted on behalf of the petitioner that he has already deposited Rs. 13,05000/- to the State Food Corporation and only Rs. 9,95,171.21/- has remained pending with the petitioner and he is still ready to deposit 20% of the aforesaid amount within four months from the date of receipt / production of the copy of this order.
No one appears on behalf of the Bihar State Food & Civil Supplies Corporation Ltd., Bihar, Patna. Heard the learned APP also.
Considering the aforesaid facts and circumstances, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudra P.S. Case No. 226 of 2016, on subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) ajaypd./- U T
