The petitioner seeks bail in connection with Bhagwanganj P.S. Case No. 13 of 2019 instituted for the offence under Section(s) 379/411 of the Indian Penal Code. It is alleged in the written report that on 12.02.2019 at about 9:40 P.M. while the informant, who is police officer, was returning, he reached near Khanpura Bridge situated on Devariya-Bhagwanganj main road and saw one red colour motorcycle was standing there. It is alleged that three persons were sitting on the bridge. Seeing the police party they started running away but they were arrested, who disclosed their name as Jitendra Kumar, petitioner and Golu Kumar. The accused persons could not produce any document with regard to

Patna High Court CR. MISC. No.25176 of 2019(2) dt.23-04-2019 2/2 aforesaid motorcycle. They disclosed that they were having stolen motorcycle.

Learned counsel for the petitioner has submitted that there is no any separate case lodged by anybody claiming aforesaid motorcycle. Petitioner has been implicated in this case merely on suspicion. He is student and making preparation of competitive examination.

Petitioner is in custody since 13.02.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Masaurhi, Patna in connection with Bhagwanganj P.S. Case No. 13 of 2019, subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
