The petitioner has entered into the service of the Road Construction Department, National Highway Division, as daily wager on 23.10.1983 and came in the work charge establishment with effect from 08.06.1988. He has been terminated from the service on 15.09.2010.

Learned counsel for the petitioner submits that he should be given the identical benefit as has been given to the

Patna High Court CWJC No.7035 of 2011 dt.11-02-2019 2/2 persons mentioned in letter dated 24.02.2015 (Annexure-6 to this writ petition), but it appears that this letter has been issued in pursuance of the order passed in C.W.J.C. No.15879 of 2005 (Annexure-7 to this writ petition). He further submits that the petitioner will file a representation before the authority concerned for redressal of his grievance.

Let the petitioner file a representation before the competent authority for redressal of his grievance. If such a representation is filed, the authority concerned will examine the facts mentioned in C.W.J.C. No.15879 of 2009 and the consequences arising from letter dated 24.02.2015 and take decision in accordance with law within a period of four months from the date of filing of representation by the petitioner. It is clarified that this Court is not giving any opinion on the merit of the case.
