JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 184 of 2018 registered for the offences punishable under Sections 30(a) and 56(d) of Bihar Prohibition and Excise Act.

As per FIR from the vehicle of the petitioner 106.500 litres of liquor has been recovered.

Submission of learned counsel for the petitioner is that he was not present at the time occurrence as he was in jail in connection with another case.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that recovery is made from the vehicle of the petitioner kept in a specially designed box, which will appear from the prosecution report, as such petitioner does not

Patna High Court CR. MISC. No.25730 of 2019(5) dt.24-10-2019 2/2 deserve bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
