====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-12-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Sessions Trial No.341 of 2019 arising out of Narhat P.S. Case No. 192 of 2016 registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
The prosecution case in short is that informant of this case has given written application to the S.H.O. of Narhat P.S. alleging therein that his daughter was married with petitioner five years back as per Hindu customs after marriage family members of his daughter mere demanding dowry, for that the informant went several time at the house of petitioner to settle the dispute.
It is further alleged that on 23.12.2016 about 10 P.M. his son call him from Delhi and said that petitioner along with
Patna High Court CR. MISC. No.24111 of 2020(4) dt.09-12-2020 2/3 family members has killed the Chanchal Kumari and her sons, then the informant went at the house of petitioner where he saw his daughter was died.
Learned counsel for the petitioner submits that the petitioner is innocent, has committed no any offence and has falsely been implicated in this case. He further submits that the trial is going on and two witnesses have been examined. By order dated 18.09.2020, report has been called for regarding the stage of trial in connection with Sessions Trial No.341 of 2019 arising out of Narhat P.S. Case No.192 of 2016. A report has been enclosed at flag 'R'.
I have perused the record. The learned Additional District and Sessions Judge-VII, Nawada has mentioned that two witnesses have been examined and due to Pandemic Covid19, rest witness has not been examined. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail. Accordingly, the prayer for bail of the petitioner in connection with Sessions Trial No.341 of 2019 arising out of Narhat P.S. Case No.192 of 2016 pending in the court of learned A.D.J.
