JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-04-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Gopalpur PS case no. 276 of 2017 registered for the offences punishable under Sections 419, 420/34 of Indian Penal Code.

The allegation against the petitioner is that he had committed manipulation on account of which the amount which was to be deposited in the government's account by RTGS had infact, gone to the account of one Rajiv Kr. Priyadarshi. This Court by an order dated 17.02.2018 had directed the investigation officer to verify as to whether the said amount has been returned back in the government fund, as was submitted by the learned counsel for the

Patna High Court Cr.Misc. No.9024 of 2018 (3) dt.03-04-2018 2/2 petitioner. The investigating officer of the present case has filed a report before this Court which is dated 09.03.2018 and it has been submitted that the entire sum of Rs. 1,99,835/- has been returned. The learned counsel for the petitioner submits that the petitioner is having a clean antecedent.

The said position is not disputed by the learned A.P.P. for the State.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Naugachia in connection with Gopalpur PS case no. 276 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
