09-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Sakra P.S. Case No. 94 of 2021, registered for the offence under Section 302/34 of the Indian Penal Code.

As per the F.I.R., on 23.01.2021, the informant got an information that his sister has been burnt, thereafter, he went to her house and found her sister badly burnt and sister of informant disclosed that all the F.I.R. named accused persons including this petitioner brutally assaulted her and thereafter, burnt her by sprinkling kerosene oil on her body. Petitioner is husband of the deceased. No such occurrence, as alleged in the F.I.R., has taken place. In fact, the deceased committed suicide due to some family dispute. Patna High Court CR. MISC. No.36995 of 2021(2) dt.09-12-2021 2/2 306 of the I.P.C. only against this petitioner and thereafter, submitted final form against other co-accused. Petitioner is in custody since 22.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XII, Muzaffarpur in connection with Sakra P.S.
