JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 560 of 2014 registered under Sections 366 and 366A of the Indian Penal Code. The accusation is of kidnapping of daughter of the informant by this petitioner and other two named accused with intention to perform marriage.

Learned counsel appearing on behalf of the petitioner submits that, in fact, victim, daughter of the informant, herself went to Saidpur and called this petitioner and stayed there at rented house and also performed the marriage in Shyama Temple at Darbhanga, according to her sweet will, which would appear from the statement of the victim, as

P.C. on 08.06.2015 and she also disclosed her age 20 years and the Court below also assessed her age about 17 years. As such, the allegation of kidnapping of the victim, daughter of the informant, is totally false. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 560 of 2014 (G.R. No. 4506 of 2014) subject to the condition as laid down under Section 438(2) of the Cr. P.C.
