JUSTICE PARTHA SARTHY ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Special Case No.13 of 2019 (Bounsi P.S. Case no. 255 of 2019) registered under sections 20, 22 and 23 of the NDPS Act.

As per allegation in the FIR, 11.5 Kg. of ganja was recovered from the bag pack of the petitioner. It is submitted by learned counsel for the petitioner that no recovery as alleged have taken place. Neither the bag pack nor the allegedly recovered ganja belong to him. He has no criminal antecedent and is in custody since 13.10.2019. The application for bail is opposed by learned APP for the State.

No.25738 of 2020(4) dt.14-12-2020 2/2 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Special Case No.13 of 2019 (Bounsi P.S. Case no. 255 of 2019) on his furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Banka.
