The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code. The prosecution case is that the informant along with his friend was going to give Rs.20,000/- to gold smith when the accused persons surrounded the informant when coaccused Chhathu Singh caused injury knife to the informant, this petitioner snatched gold chain from the possession of the informant worth Rs.25,000/-, co-accused Raja Singh snatched Rs.20,000/- and the accused persons escaped from the scene on motorcycle.

No.55762 of 2015 (2) dt.15-12-2015 2/2 It is submitted by learned counsel for the petitioner that Section 107 Cr.P.C. proceeding was initiated between the parties from before and in that background the accusation has been levelled. The accusation of assault and taking away rupees twenty thousand have not been alleged against the petitioner. It is only alleged against the petitioner that he snatched gold chain.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts may constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Manjhagarh P.S. Case No. 108 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Gopalganj.

With the aforesaid observation, this application is disposed of.
