The petitioners seek pre-arrest bail in connection with Amdabad P.S.Case No. 161 of 2017 registered under Sections 341, 323, 324, 506 and 379/34 of the Indian Penal Code. Regard being had to the allegation made against the petitioner no.1 Batoran Yadav that he assaulted the informant with sickle causing grievous injury on his neck, I am not inclined to grant him pre-arrest bail. Accordingly, his application for grant of pre-arrest bail is rejected.

So far as the petitioner no.2 Vikash Yadav is concerned, he is alleged to have assaulted the wife of the informant with lathi. However, considering the fact that there is no

No.5618 of 2018 (2) dt.08-02-2018 2/2 injury on the person of the wife of the informant, in the event of arrest or surrender before the court below within four weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar in connection with Amdabad P.S.Case No. 161 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
