JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B) A, 26, 35 of the Arms Act.

One country made katta is said to have been recovered from possession of the petitioner when police party raided the house of the petitioner having got information regarding the firing made by the petitioner causing injury to his co-villager Anil Yadav. Admittedly, for causing firearm injury to Anil Yadav, a separate case i.e. Sasaram (M) P.S. Case No. 87 of 2018 was registered against the petitioner.

Learned counsel appearing for the petitioner drew my

Patna High Court CR. MISC. No.24661 of 2019(2) dt.18-04-2019 2/2 attention towards Annexure-2 to the petition and submits that in Sasaram (M) P.S. Case No. 87 of 2018, petitioner has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 17.12.2018 passed in Cr. Misc. No. 71325 of 2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 17.07.2018 and except the present case as well as Sasaram (M) P.S. Case No. 87 of 2018, petitioner does not have any other criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned I/c Chief Judicial Magistrate, Sasaram/ concerned court in connection with Sasaram (M) P.S. Case No. 88 of 2018.
