JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Khajekalan P.S. Case no. 49 of 2017, registered under Sections 323, 341, 504 and 307/34 of the Indian Penal Code. The accusation is that informant Amarjit Kumar used to reside with his parents peacefully separate with his two brothers and used to run the shop; before two months his shop was forcibly closed by petitioners and both the petitioners also abused the informant and his parents. When informant made protest then petitioners assaulted the informant with intention to kill him.
Learned counsel for the petitioners submits that petitioners and informant are own brothers and due to land dispute, the occurrence of Marpit took place in which petitioners also sustained
Patna High Court Cr.Misc. No.47320 of 2017 (2) dt.04-10-2017 2/2 injuries regarding which Khajekalan P.S. Case No. 50 of 2017, under Sections 323, 341, 504, 354 and 379/34 is instated against informant and his two associates. Moreover, the injury as found on the person of the informant is simple in nature caused by hard and blunt substance. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Patna City in connection with Khajekalan P.S. Case No. 49 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
