2. The petitioner seeks bail in a case registered for the offence punishable under Sections 399, 400, 401, 402, 412, 414 and 120B of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per prosecution case, on secret information that some miscreants have gathered to commit dacoity at Punjab National Bank at Anisabad, a raid was conducted and eight accused persons, including this petitioner, were apprehended with arms and ammunition and looted articles. On search, one loaded pistol and huge amount of cash was recovered from
Patna High Court CR. MISC. No.31323 of 2024(7) dt.04-04-2025 2/2 possession of this petitioner.
4. Perusal of the trial court report dated 14.11.2024 reveals that 5 out of 10 charge-sheeted witnesses have already been examined, cross-examined and discharged. One witness has died during pendency of the case and remaining 4 witnesses, including informant and I.O., are yet to be produced by prosecution for examination. Petitioner is in custody since 04.07.2020.
5. Considering the aforesaid facts and circumstances of the case, tardy progress of trial and period of custody, the prayer for grant bail of to the petitioner is allowed.
6. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XVII, Patna in connection with Jakkanpur P.S.
