The petitioner seeks bail in Banka P. S. Case No. 659 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
In the written report, it is alleged by the informant that his younger son was working as contractor in a bus where he developed intimacy with petitioner who was running a tea shop in the bus stand. It has further been alleged that deceased was seen with petitioner in a shop by co villager of informant who went to Deoghar for worship as Dak Bumb. It is further alleged that on 28.9. 2018 the informant has been informed on telephone by his daughter that she has been informed by the
Patna High Court CR. MISC. No.26695 of 2019(4) dt.10-07-2019 2/2 S.H.O. of the Banka Police Station that Santosh Kumar Singh ( deceased ) is lying dead in a temple.
It has been submitted that petitioner is not named in the FIR. The name of this petitioner has come in the confessional statement of co-accused Ganesh Pandit. Petitioner is in custody since 30.9.2018 having no criminal antecedent. She is a lady.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IV, Banka, in connection with , Sessions Trial No. 74 of 2019 Banka P.S. case no. 659 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
