Petitioner seeks bail in connection with Sessions trial no. 214/2020 arising out of Naubatpur P.S. Case no. 472 of 2019 registered for the offence punishable under section 395 of the Indian Penal Code.

This is second attempt. Petitioner seeks bail on the strength of order dated 17.12.2019 in Cr. Misc. no. 76003/2019 wherein this court had granted liberty to the petitioner to renew his prayer for bail after framing of the charge. Learned counsel for the petitioner submits that despite his best effort, charge till date could not be framed. Learned APP submits that from perusal of the

Patna High Court CR. MISC. No.37091 of 2021(3) dt.03-01-2022 2/2 impugned order, it appears that it was the petitioner who was not cooperating in getting charge framed.

Be that as it may since by earlier order, this court had granted privilege to the petitioner to renew his prayer for bail after framing of the charge, same condition is again imposed on the petitioner to renew his prayer for bail after framing of the charge.

At this stage, learned counsel for the petitioner submits that he is willing and ready to get the charge framed and for that he will be filing an application before the learned court below. (Satyavrat Verma, J) s.hassan/- U T
