JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-02-2021 Heard Sri Sanjay Kumar Tiwari, learned counsel appearing for the petitioner, Sri A.M.P. Mehta, learned A.P.P. appearing for the State and Sri Surendra Kumar Choubey, learned counsel appearing for the informant.

The petitioner apprehends her arrest in connection with Akorih Gola P.S. Case no. 215 of 2019, registered under Section 304(B) of the Indian Penal Code.

The accusation is that on 25.06.2019, informant Anand Kumar performed the marriage of his daughter, aged about 21 years, with Rahul Kumar. Thereafter, she went at her matrimonial house, where, after some times, she was being tortured for demand of cash Rs. Two lakhs and Bullet motorcycle. The informant refused to fulfill the said demands saying that he has already gifted articles as per his capability. Thereafter, husband and other in-laws of his daughter started giving threatening to kill her and, ultimately, on 04.11.2019 his

Patna High Court CR. MISC. No.27875 of 2020(3) dt.01-02-2021 2/2 daughter has been killed by pressing her neck and put on fire. Learned counsel for the petitioner submits that, in fact, on the fateful night, the petitioner, who is mother-in-law of the deceased along with her husband, was in adjacent room, whereas the deceased was in another room and on visualizing the smoke, the room of the deceased was dashed, which was bolted from inside then the deceased, daughter in law of informant, found dead sustaining burn injuries and a blade was also found there. Further submission is that Rahul Kumar, husband of deceased, is in custody. The petitioner, who is lady, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Akorih Gola P.S. Case No. 215 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
