JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Tikari P.S. Case No. 131 of 2018 for the offenses under Sections 498A, 304B, 34 of the Indian Penal Code and Sections 3 & 4 of D.P.Act.

Learned counsel for the petitioner would submit that petitioner is not a family member of the husband of the deceased. He is a villager and has no criminal antecedent. The petitioner is in custody since 30.1.2019.

Considering the fact that the petitioner has no criminal antecedent and he is not the family member of the

Patna High Court CR. MISC. No.27303 of 2019(3) dt.29-05-2019 2/2 husband of the deceased, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Tikari P.S. Case No. 131 of 2018.
