The petitioner seeks regular bail in connection with POCSO Case No. 28 of 2020, arising out of Sasaram Town Police Station Case No. 167 of 2020, registered for the offences punishable under Sections 290/34 of the Indian Penal Code, Sections 3(1)/3(2)/4/5/6/7 of the Immoral Traffic (prevention) Act, 1956 and Sections 4/16 of the POCSO Act. The prosecution case, as per the First Information Report, is that the police, on the basis of secret information, raided one Kaimur Hotel, situated near post office chowk and found six boys and six girls in objectionable condition and the boys disclosed that the Manager of the hotel had called the girls

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged inasmuch as he had visited the hotel as a customer. He further submits that the proprietor of the Hotel, namely, Vishal Bahadur Singh, and similarly situated co-accused, Shyam Ji, have been granted bail by this Court, vide orders passed in Criminal Misc. Nos. 27546 and 24493 of 2020. He further submits that the petitioner is in custody since 03.03.2020.

After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that similarly situated co-accused person has been granted bail by this Court and the petitioner is in custody since 03.03.2020, I am inclined to grant bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Rohtas, at Sasaram, in connection with POCSO Case No. 28 of 2020, arising out of Sasaram Town Police Station Case No. 167 of 2020.
