Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 409 and 420/34 of the Indian Penal Code.
The Headmasters of different Government School within Kursakanta block of Araria district withdrew money meant for distribution to the students under the scholarship scheme and deposited in the personal bank account of the respective Headmasters. That is the allegation in the First Information Report. During investigation, it revealed that the entire conspiracy was hatched by this petitioner who was posted as Computer Operator in the District Welfare Office, Araria.
Patna High Court Cr.Misc. No.52957 of 2016 (3) dt.18-01-2017 2/2 Submission of the petitioner is that there is no role, at all, of the petitioner in allowing withdrawal of the money from the government account or the manner of its disbursement hence, just to harass, the present false case has been lodged. Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court in connection with Kursakanta P.S. Case No. 154 of 2016.
