Petitioner apprehends arrest in connection with Dinara P.S. Case No. 102 of 2007 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner alongwith his family members have been made accused in this case on account of quarrel which took place between the boys in the playground during a cricket match. Petitioner has no concern with the alleged occurrence. Learned Addl. P.P. appearing for the State and the learned counsel appearing for the informant opposes the prayer for bail and submits that petitioner is named in the first information

Patna High Court Cr.Misc. No.44930 of 2017(3) dt.14-11-2017 2/2 report and there is specific allegation of assault against him. During investigation witnesses have supported the prosecution case. Injuries sustained by the informant supports the allegations levelled.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
