The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code and 27 of the Arms Act. Allegation is that the informant along with one Ravishankar Kumar was carrying Rs.3,70,000/- cash, suddenly two persons came and fired two shot and they snatched the bag containing aforesaid amount and they also took key of the motorcycle and managed to escape.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.01.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional

Patna High Court CR. MISC. No.26226 of 2019(2) dt.23-04-2019 2/2 statement of co-accused. There is no recovery from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. It is further submitted that the petitioner may be released on bail after completion of seven months in custody from 29.01.2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of seven months in custody from 29.01.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rohan Kumar, Judicial Magistrate 1st class, Banka in connection with Katoria P.S. case No.240 of 2018.
