The petitioner apprehends his arrest in Patliputra P.S. Case No. 276/15 registered under Sections 406, 420 of the Indian Penal Code.

The informant alleged that he was in need of a flat for his residence. The informant came across with his old acquainted person Sanjay Singh (the petitioner), who introduced Raj Kishore Singh. Raj Kishore Singh disclosed that he has already got a deed of agreement with regard to a flat situated in Patliputra Colony. The informant alleged that he gave three cheques of rupees 11 lacs, 3 lacs and 10 lacs in the name of Raj Kishore Singh who encashed the entire amounts but did not transfer the flat in the name of the informant. The informant enquired from the builder and came to know that no deed of agreement was executed by him

Patna High Court Cr.Misc. No.41138 of 2016 (2) dt.22-09-2016 2/2 in favour of Raj Kishore Singh.

Learned counsel for the petitioner submits that the petitioner is innocent. The petitioner simply introduced Raj Kishore Singh to the informant as Raj Kishore Singh was a property dealer. The petitioner did not receive any money from the informant nor any cheque was issued in favour of the petitioner. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Patliputra P.S. Case No. 276/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
