The petitioners apprehend their arrest in Bagha (Pathkhauli) P.S. Case No. 65 of 2017 for the offences under section 307 and other sections of the Indian Penal Code. The informant named the petitioners and alleged that bullock cart of the petitioner Vindyachal Yadav caused injury to his son. Some verbal altercation took place on which Vindyachal Yadav, the petitioner no. 1 called other accused. It is further alleged that Umesh Yadav, son of Sakal Dev Yadav, who is not petitioner herein, assaulted the informant with iron rod on head and Sunil Yadav who is also not petitioner herein, assaulted Sonu

Patna High Court Cr.Misc. No.34947 of 2017 (2) dt.11-08-2017 Pathak, friend of the informant. The petitioners are also alleged to have assaulted the informant and his family members. Learned counsel for the petitioners submits that Munna Kumar and Sonu Pathak got one injury. There is no other injury on the body of the informant or his friend Sonu Pathak. Considering the fact that the petitioners are alleged to have assaulted but no injury was found on the body of the informant and Sonu Pathak got single injury which is attributed to Umesh Yadav son of Sakal Dev Yadav, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate-1st, Bagaha, District-West Champaran in connection with Bagaha (Pathkhauli) P.S. Case No. 65 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
