Patna High Court CWJC No.19519 of 2015(2) dt.28-03-2023 2/3 following relief:- "1. That this is an application for the issuance of appropriate writ/writs, order/orders, directions to the Respondents concerned and especially to the respondent nos. 2 to 8 to remove the encroachment made on the raiyati land of the petitioners (described in paragraph no. 3 of the writ application), which are in the shape of a concrete road and sewerage tank, made forcefully under different government scheme by the Respondents 1st set upon the part of land of the petitioners, for the benefit of respondents 2nd set, who are members of local "Panchayat Samiti, and are very influential persons and thereby the petitioners have been deprived of their property without any authority of law."

At the outset, the learned counsel for the RespondentState has referred to the counter affidavit, filed in the present case, more particularly paragraph no. 13 thereof, wherein it has been stated that encroachment has already been removed from the private land of the petitioners and possession thereof has been handed over to them.

In view of the aforesaid, the learned counsel for the petitioners submits that at the moment, the petitioners are not having any subsisting grievances.
