JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Gaurichak P.S. Case no. 189 of 2017, registered under Sections 147, 341, 323, 353, 427, 504 and 506 of the Indian Penal Code. The accusation is that 50 to 60 persons, including the petitioners, came at the office of the informant, who is Junior Engineer, Electricity Supply Division, Sampatchak and started to interrupt the official work and damaged the government property and also shut down the electric supply. At that time, some officials sustained blood oozing injury.
Learned counsel for the petitioners submits that, in fact, the transformer of the mohalla of the petitioners was not functioning
Patna High Court Cr.Misc. No.47015 of 2017 (2) dt.03-10-2017 2/2 since one month and due to that reasons, petitioners and other people reached at the office of Electricity Supply Division, Sampatchak and made complaint regarding non-functioning of the transformer, where hot talks were exchanged between them, but with ulterior motive, the petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City, Patna in connection with Gaurichak P.S. Case No. 189 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
