The petitioner has preferred this application for grant of regular bail in a case registered under sections 341, 323, 307 and 504 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the petitioner along with three unknown persons came and fired three rounds on the informant with the intention to kill, out of which one pellet hit on his leg. On halla, the petitioner and the three unknown

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The informant has sustained injury on non-vital part of the body. The petitioner is accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 01.02.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the informant sustained firearm injury on his leg. Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 34 of 2022.

The application stands allowed.
