JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 05-01-2016 Petitioner claims that since the date he joined the post of Panchayat Sevak in the year 2003, he has not been paid even a single farthing of salary even today.

Learned counsel appearing on behalf of the petitioner has submitted that despite several representations, filed by the petitioner, the respondents have not paid him his due salary. Learned counsel appearing on behalf of the respondentsState of Bihar has, on the other hand, submitted that this writ petition does not deserve to be entertained, there being inordinate delay and

Patna High Court CWJC No.19673 of 2015 dt.05-01-2016 2/2 laches on the part of the petitioner in approaching this Court by way of filing the present writ application.

Having seen the pleadings on record and the submissions made on behalf of the parties, in peculiar facts and circumstances of the present case, I direct the District Magistrate, Buxar to look into the grievance of the petitioner by giving him an opportunity of personal hearing if he makes a representation, giving details of his claim within two weeks from today. The District Magistrate, Buxar is directed to pass an appropriate order thereafter as regards petitioner's claim of salary for the period in question. If the petitioner's claim does not find favour with the District Magistrate, he will be required to assign reasons for the same, in his order, which must be passed within two months from the date of receipt of representation, to be filed by the petitioner in the light of the present application. The petition stands disposed of accordingly, with the aforesaid direction and observation.
