ANJANA MISHRA ORAL ORDER 15-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Turkauliya (Banjariya) P.S. Case No. 690 of 2015 , registered for offences punishable under Sections 420, 467, 468, 471, 120B, 323, 307, 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there has been a dispute between the parties regarding the sale of the plot. Some allegations have been leveled against him that when he went to measure and take possession of the land, the petitioners no. 1 and 2 came upon him and by putting a Gamcha on his person tried to strangulate him. Learned counsel for the petitioners further submits that the dispute is purely of civil nature and now the
Patna High Court Cr.Misc. No.57551 of 2015 (2) dt.15-01-2016 2/2 parties have compromised the matter.
Considering the aforementioned facts and circumstances, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Eash Champaran, Motihari in connection with Turkauliya (Banjariya) P.S. Case No. 690 of 2015 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
