The petitioners apprehend their arrest in Turkauliya P.S. Case No.661 of 2017 registered under Sections 147, 341, 323, 332, 353, 504, 333 of the Indian Penal Code and Section 11 of the Public Gambling Act.
The informant alleged that when he and other police officials arrived at the door of Umesh Bhagat, the informant saw the petitioners and others were playing gambling. On query, the petitioners began to assault the informant.
The learned counsel for the petitioners submits that no specific allegation of assault is made against the petitioners. Similarly situated five accused persons Sheo Shankar Sah and
Patna High Court Cr.Misc. No.17585 of 2018 (2) dt.05-04-2018 others have already been granted anticipatory bail vide order dated 28.02.2018 passed in Cr. Misc. No.12347 of 2018. The case of the petitioners stands on the same footing.
Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No.661 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
