JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nautan (Jagdishpur) P.S. Case no. 255 of 2017, registered under Sections147, 149, 341, 323, 324, 379, 295(A) and 504 of the Indian Penal Code and Section 11(i)(L) of the Prevention of Cruelty to Animal Act.

The accusation is that before one year, the informant set free calf in the village in connection with ritual purpose. On 26.06.2017, when villagers were going to attend the call of nature, then saw the skin of said bull in front of the house of Dildar Mian then matter was informed to the informant. Thereafter, informant and others went there and found blood stained plastic bucket. On query, Dildar Mian and 9 others, including the petitioner, having Garasi, Lathi etc.

Patna High Court Cr.Misc. No.42385 of 2017 (2) dt.20-09-2017 2/2 started to abuse the informant and made attempt to cause assault. Learned counsel for the petitioner submits that petitioner along with 9 others is named in the F.I.R. mere on suspicion and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan (Jagdishpur) P.S. Case No. 255 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
